The Livermore City Council is scheduled for a special meeting Thursday to decide whether to appoint two uncontested incumbents in lieu of holding an election for their posts this fall.

Candidates considered for appointment are Mayor John Marchand and Councilmember Evan Branning for District 1.

Under the California Elections Code, the City Council has the option to appoint the uncontested candidates or hold an election, according to the staff report prepared by Livermore city clerk Olivia Nashed.

If the City Council does not approve a resolution Aug. 20 appointing the duo and canceling the Nov. 3 election for the seats, the election will be held, Nashed said.

If canceled, the city estimates a cost savings of approximately $200,000 to $300,000.

Regardless of the council’s decision, the race for District 2 featuring incumbent Ben Barrientos and newcomer Narayan Tadimeti will be on the November ballot for voters in the northeast district.

The special meeting is scheduled to begin at noon on Thursday (Aug. 20). The agenda is available here.

In other business

The council will consider adopting a resolution to allow the city manager to execute a $2,285,985 construction contract with Bay Cities Paving & Grading, Inc. for the Livermore Village Remediation Project. It will also decide whether to authorize again the supplemental appropriation of $75,000 from the low-income housing fund to replace human services facility fees for the project.

The project involves the removal of soil material with historic contamination of heavy metals ahead of constructing the Downtown Workforce Housing Project, formerly known as Eden Housing.

The item was prompted by a Brown Act demand to the city regarding its alleged noncompliance with the act in noticing the initial contract resolution before council in July.

The city disputed the allegation, but “for the avoidance of doubt and to promote transparency in the public process, staff revised the agenda description and recommended the City Council reconsider the item,” according to the staff report prepared by Livermore senior civil engineer Rick Teczon.
