Nearly three years after he was first arrested on child sex abuse allegations, a former biology teacher and cheer coach in the San Ramon Valley is returning to court this week for a jury trial in the criminal case.
The trial on charges against former SRVUSD teacher Nicholas Moseby kicked off Monday, during which the judge heard motions from both sides, with jury selection expected Tuesday, according to the district attorney’s spokesperson Ted Asregadoo.
Moseby has pleaded not guilty to the allegations of sexual harassment and assault brought forward by three unnamed former students from his time as a teacher at San Ramon Valley High School and Diablo Valley Middle School and as a cheer coach at Nor Cal Elite in San Ramon.
The criminal charges from the Contra Costa County District Attorney’s office were filed in September 2022, with Moseby being taken into custody shortly after. He was released on bail that December.
The trial had initially been scheduled for November 2023. It was postponed a total of eight times before kicking off this week, for a variety of reasons including requests for more time from both sides and scheduling conflicts for the attorneys and judge.
Meanwhile, Moseby was served with a parallel civil lawsuit from the alleged victims last November, which names the school district, several former administrators, and Nor Cal Elite. He has filed a cross-complaint in that case, alleging that the plaintiffs and their classmates have engaged in a coordinated effort to target and harass him due to personal biases against him.
The criminal case had initially been assigned to Contra Costa Superior Court Judge John Kennedy. It is now proceeding before Judge Joni Hiramoto due to unavailability on Kennedy’s end, Asregadoo said.
