Livermore City Council is scheduled to hold a public hearing today regarding annexation of the SMP 40 project land into the city’s maintenance district.
Located just south of city limits at the southern end of Discovery Drive and Atlantis Court, the project was conditioned to annex into city limits and join a maintenance district to finance the upkeep, operation and replacement of an on-site trail and other services associated with the project, according to the agenda.
SMP 40 refers to the the Surface Mining Permit numbers applicable to the site of a proposed project that would include development of two industrial buildings containing up to approximately 759,275 square feet of new building space with related internal roadways, parking, landscaping, utilities, and other improvements, according to the city’s website.
Given the council’s approval of formal annexation into the city in August 2024, developer Overton Moore now seeks inclusion into the future annexation area for the City of Livermore Community Facilities District No. 2021-1 — which finances a broad range of municipal services in the city — for the remainder of the obligation.
Properties like SMP 40 may enter the CFD through a streamlined procedure where they first enter a “future annexation area”. Entrance into a future annexation area streamlines the annexation of future development projects, by eliminating multiple city council meetings for each annexation proceeding.
Previously, the council adopted a resolution declaring the intention to add the project parcel to the future annexation area for CFD 2021-1 and calling for a public hearing, Jan. 27, 2025.
The public hearing today is an opportunity for the public to ask questions about the addition of territory to the future annexation area.
If a sufficient number of the public submits written protest to the city clerk, then the proposed addition of the SMP 40 parcel to the future annexation area would halt the proceedings.
Barring protest, the city council is set to consider a resolution adding the parcel to the future annexation area for CFD 2021-1. The parcel would then be allowed to be annexed into CFD 2021-1 without further public hearings or additional proceedings, as long as its owners execute a unanimous approval.
All expenditures related to the annexation into the CDF would be financed through the special taxes levied in CFD 2021-1.
